CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

1.     By placing an order electronically on the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement provided to you.

2.     Buyers are subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), and other applicable laws related to the sale and delivery of the purchased product.

3.     The shipping costs, including the cost of product delivery, will be paid by the buyer.

4.     Each purchased product will be delivered to the person and/or organization at the address provided by the buyer within 30 days, not exceeding the statutory period. If the product is not delivered within this period, the buyer may terminate the contract.

5.     The purchased product must be delivered in accordance with the specifications stated in the order, complete and with any documents such as warranty certificates and user manuals, if applicable.

6.     In case the purchased product becomes impossible to sell, the seller must notify the buyer of this situation in writing within 3 days after learning of the issue. The total amount must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT FEE IS NOT PAID:

1. If the buyer does not pay the price of the purchased product or cancels the payment in the bank records, the seller's obligation to deliver the product will cease.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

1. If it is determined that the credit card used by the buyer for payment has been fraudulently used by unauthorized individuals after the product is delivered, and the payment for the product is not made to the Seller by the relevant bank or financial institution, the Buyer is obligated to return the product to the SELLER within 3 days, with the return shipping costs covered by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

1. If force majeure events, which the Seller cannot foresee, occur and the product cannot be delivered on time, the Buyer will be notified. The Buyer may request to cancel the order, replace the product with a similar one, or postpone the delivery until the obstacle is removed.

 

 

 

 

If the Buyer cancels the order and has paid in cash, the payment will be refunded in cash within 14 days from the cancellation. If the Buyer made the payment with a credit card and cancels the order, the product price will be refunded to the bank within 14 days of the cancellation. However, it is possible that the bank may take 2-3 weeks to transfer the amount to the buyer's account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

1. The Buyer must inspect the goods/services before receiving them; they should not accept any damaged or defective goods/services, such as those with dents, cracks, or torn packaging, from the courier company. Once the goods/services are received, it will be assumed that they are undamaged and intact. The Buyer is obligated to take good care of the goods/services after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice should also be returned along with the product.

RIGHT OF WITHDRAWAL:

1. The BUYER may exercise the right of withdrawal by rejecting the product and notifying the SELLER through the contact details below within 14 (fourteen) days from the delivery date of the product to themselves or the person/organization at the address they provided, without assuming any legal or criminal liability and without providing any justification.

CANCELLATION RIGHT PERIOD:

1. If the product purchased is a service, the 14-day period starts from the date the contract was signed. In service contracts where the service has begun with the consumer's consent before the cancellation period expires, the right of withdrawal cannot be exercised.
2. The costs arising from the use of the right of withdrawal are borne by the SELLER.
3. To use the right of withdrawal, the consumer must notify the SELLER in writing via registered mail, fax, or email within the 14-day period, and the product must not have been used in accordance with the "Products for Which the Right of Withdrawal Cannot Be Exercised" provisions outlined in this agreement.

USE OF THE RIGHT OF WITHDRAWAL:

1. The invoice of the product delivered to the 3rd party or the BUYER (If the product to be returned has a corporate invoice, it must be sent along with the return invoice issued by the institution. Returns of orders invoiced on behalf of institutions will not be completed unless a RETURN INVOICE is issued.)
2. The return form, along with the box, packaging, and any standard accessories of the product to be returned, must be delivered completely and without damage.

RETURN CONDITIONS:

1. The SELLER is obliged to return the total amount and the documents that put the BUYER under debt to the BUYER within a maximum of 10 days after receiving the withdrawal notification, and to take back the goods within 20 days.
2. If the value of the goods decreases or the return becomes impossible due to the fault of the BUYER, the BUYER is liable to compensate the SELLER for the damages in proportion to the fault. However, the BUYER is not responsible for any changes or damages that occur due to proper use of the product or goods during the right of withdrawal period.
3. If the amount falls below the campaign limit set by the SELLER due to the use of the right of withdrawal, the discount obtained within the campaign will be canceled.

PRODUCTS ON WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

1.     Products that are prepared according to the BUYER’s request or explicitly based on personal needs and are not suitable for return, such as lingerie bottoms, swimsuits, bikini bottoms, makeup materials, disposable products, products that are at risk of spoiling quickly or likely to expire, products that, once opened by the BUYER,

 

 

 

 

 are unsuitable for return for health and hygiene reasons, products that mix with other products and are inherently inseparable after delivery, goods related to periodicals like newspapers and magazines unless provided under a subscription agreement, services performed immediately in the electronic environment or intangible goods delivered to the consumer immediately, along with sound or video recordings, books, digital content, software programs, data recording and storage devices, computer consumables, and products whose packaging has been opened by the BUYER are not subject to return under the Regulation. Furthermore, the right of withdrawal cannot be used for services that have started to be performed with the consumer's approval before the right of withdrawal period expires.

2.     Cosmetic and personal care products, lingerie, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs, cassettes, and stationery consumables (such as toner, cartridges, ribbons, etc.) must be unopened, unused, untried, and undamaged in order to be eligible for return.

DEFAULT AND LEGAL CONSEQUENCES:

1. If the BUYER defaults on payment transactions made with a credit card, the BUYER agrees, declares, and undertakes that they will pay interest within the framework of the credit card agreement between the cardholder and the bank and will be responsible towards the bank. In this case, the relevant bank may resort to legal means; it can claim any resulting expenses and attorney fees from the BUYER, and in any case, if the BUYER defaults due to the debt, the BUYER agrees to pay the damages and losses incurred by the SELLER due to the delayed performance of the debt.
